Welcome to Picsgram ("we," "our," or "us"). By registering for, accessing, or using the services provided on our platform at https://picsgram.in (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
1. Account Registration and Eligibility
To use Picsgram as a photographer or studio, you must register for an account. You agree to provide accurate, current, and complete information during registration. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Service.
2. Photo Ingestion, Local Sync, Google Drive & Content Rights
Picsgram offers features allowing photographers to ingest client event photos via direct Browser Photo Sync (local hard disk / SD card) or via Google Drive integration.
Content Ownership: Picsgram claims no intellectual property or copyright ownership over any photos, videos, studio logos, watermarks, or text uploaded or synced through our Service. All copyright and ownership remain exclusively with the photographer or respective copyright holders.
Photographer Responsibility: Photographers represent and warrant that they possess all necessary legal permissions, model releases, and rights to upload, display, and distribute photos synced to Picsgram client galleries.
Service License: You grant Picsgram a non-exclusive, worldwide, royalty-free license to host, process, generate web-optimized previews, watermark, cache, and transmit your media strictly for the purpose of operating client galleries, photo selections, and digital delivery as configured by you.
3. Payments, Subscriptions, and Automated Gateway Payouts
Photographer Subscriptions & Credits: Certain premium tiers, active photo capacities, and project credits are subject to subscription fees. Subscription and PAYG credit purchases are final and non-refundable once activated.
Manual UPI Client Payments: When configured for manual payment, clients pay photographers directly via the photographer's UPI QR code. Picsgram facilitates proof collection (screenshot verification) and does not hold or route those funds.
Automated Payment Gateway (Razorpay Route): When photographers enable automated client checkout, payments are processed securely via our integrated payment gateway and transferred directly to the photographer's verified bank account according to standard banking settlement schedules. Standard gateway transaction processing fees apply.
Taxes & Invoicing: Photographers are solely responsible for calculating, collecting, and reporting any applicable sales tax, GST, or income tax arising from client photo sales or album services.
4K Digital Soft Copies: Digital soft copy downloads provided to clients through Picsgram are generated in high-speed, web-optimized 4K Ultra-HD digital resolution, optimized for rapid client downloading, mobile viewing, digital sharing, and standard display.
Master / RAW File Retention: Picsgram is a client selection, digital proofing, and gallery delivery service—not a permanent uncompressed camera RAW archival storage repository. Photographers must always retain at least one physical/local copy of their uncompressed original camera and RAW master files on their own computer, SSD, or hard drives for physical album retouching, color grading, and high-resolution print production.
5. Storage Lifecycles, Expiry, and Automated Cleanup
Free Trial Capacity: Free trial accounts are subject to a fixed capacity of 500 photos for platform evaluation and trial client preview testing.
Monthly Studio Plans: Monthly plans operate on a reusable active photo pool. If a monthly subscription is not renewed on its due date, a 7-day grace period is provided. After Day 7, galleries are suspended. After Day 15 of non-payment, cloud-hosted files enter automated storage cleanup.
Pay-As-You-Go Projects: PAYG project credits remain active for their stated validity period. Following project expiration and the 7-day renewal grace window, hosted files are permanently removed to release cloud storage.
6. Smart Review, AI Grouping & Privacy Safeguards
Picsgram incorporates automated computer vision and AI tools (such as duplicate analysis, blur detection, and face grouping) to assist clients and photographers in searching and selecting photos.
All AI indexing is performed strictly within the context of the private project gallery.
Picsgram does not sell, license, or share facial biometric data or client images with third parties for public AI model training.
7. Watermarking & Digital Preview Security
Picsgram applies proprietary dynamic watermarking, right-click locking, and download safeguards to unapproved gallery previews. While Picsgram uses industry-standard protective measures, photographers acknowledge that no web-based platform can guarantee complete prevention of external screen capture or third-party camera recording.
8. Prohibited Conduct
You agree not to use the Service for any of the following:
Uploading, syncing, or distributing unlawful, adult, abusive, defamatory, or infringing materials.
Attempting to reverse engineer, decompile, or bypass platform security, download locks, or watermarks.
Deploying automated scrapers, crawlers, bots, or excessive requests designed to overload platform infrastructure.
9. Limitation of Liability
The Service is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by applicable law, Picsgram and its operators are not liable for any direct, indirect, incidental, special, or consequential damages resulting from data loss, local hardware failure, client payment disputes, or temporary service interruptions.
